By submitting this order, you acknowledge that you have read, understood, and agree to be bound by the Rental Agreement and Terms & Conditions of LA Violin Shop.

School Year Term Rental Terms & Conditions

Thank you for choosing LA Violin Shop (LAVS) for your rental needs. The School Year Rental Plan runs from the start of the academic school year through June 30 each year. For the purposes of this agreement, the school year is defined as September 1 – June 30, unless otherwise specified by LAVS. Renewal for the next school year occurs automatically on July 1, unless the instrument is returned to LAVS by June 28. All rental instruments, bows, and cases remain the sole property of LAVS at all times. Renters obtain no ownership rights under this agreement.

· School Year Duration: The School Year Rental Plan runs from September 1 – June 30 each year.

· Automatic Renewal: The rental agreement automatically renews on July 1 of each year for the following school year, unless the instrument is returned by the deadline.

· Return Deadline: Instruments must be returned to LAVS no later than June 28 to avoid renewal. Returns to schools or third parties are not accepted.

· No Refunds: Rental fees are non-refundable once charged. No prorated refunds will be issued.

Instrument Options

· Graduated Sizes and Instrument Choice: LAVS provides good-quality, shop-set-up student-level violin, viola, or cello outfits.

· Upsizing: Renters may move up in instrument size during the school term at no additional cost.

· Interchangeability: Instruments are not interchangeable between types (e.g., violin to cello).

· No Rental Credit: School Year Rentals do not accrue rental credit. This is a rental-only program and does not convert to ownership.

Instrument Maintenance and Coverage

LAVS commits to maintaining the covered instrument and bow in excellent playing condition. In case of accidental damage, fire, or theft, LAVS will undertake repairs or replacements using items of comparable make, quality, and condition, in accordance with the provisions outlined in these Terms and Conditions.

· Eligibility: Protection Plan coverage is applicable only to instruments, bows, and/or cases rented from LAVS. Accessory items and strings are not covered. Instruments, bows, and/or cases used for paid performances are not eligible for coverage. The Protection Plan is exclusively available to the original renters from LAVS and is non-transferable. Fees paid for the Protection Plan are non-refundable.

· Customer Responsibility: Customers are responsible for presenting the instrument, bow, and/or case to LAVS at their own expense. This presentation should occur at LAVS's regular business location(s), either in person or through a common carrier, for required repairs or replacements.

· Suspension and Reinstatement: If Rental Customers are more than 15 days overdue in their payments, the Protection Plan will be suspended. Reinstatement will be effective upon settling all overdue charges, including any additional Finance and/or Late Charges as stipulated in the customer’s contract. During a suspension period, loss or accidental damage will not be covered. Repair or replacement costs will be the responsibility of the customer at the prevailing rates.

· Liability Limitation: LAVS's liability shall not exceed the lesser of restoring the covered item to playing condition or providing a replacement. LAVS holds sole authority to interpret the applicability of Protection Plan terms. The method of repair, maintenance, or replacement is at the full discretion of LAVS. The Protection Plan does not entitle the renter to a cash settlement. LAVS reserves the right to cancel protection if the customer is found negligent or intentionally abusive. LAVS also reserves the right to pursue legal remedies to protect its ownership or security interest in the instrument, bow, and/or case.

· Liability for Cancellation or Damage: The Protection Plan is required with all rentals; however, renters remain responsible for excessive wear, major damage, unauthorized repairs, and any form of loss—including total loss—not covered under the Protection Plan. In such cases, a pro-rated replacement cost may be charged, determined at the sole discretion of LAVS. Exclusions from coverage include cosmetic damage that does not affect tone or playability, loss due to negligence, mysterious disappearance, unauthorized repair, arson, vandalism, or intentional abuse. Damage caused by third parties is also not covered, and related repair costs are the responsibility of the renter. Renters are fully liable for negligence, misconduct, or loss. In the event of loss, a deductible of 50% of the retail price will apply if verifiable proof is provided. Otherwise, the full retail value is due. Loss from school premises is not covered.

· Proof of Loss: For theft or fire claims, proof of loss is mandatory. In case of theft, customers must report to law enforcement within 15 days and provide a copy of the police report. For fire, the remains of the instrument, bow, and/or case must be provided. A detailed, signed statement describing the loss circumstances is required for all claims.

Fee Structure

· Late Fee: A late fee of $9.00 will be charged if the automatic payment through ACH fails or if you neglect to update your credit card information prior to the payment due date.

· Handling Fee for Outdated Information: Customers who fail to maintain current credit card or checking account information will be subject to a $25.00 handling fee.

· Chargeback Prohibition: By signing this agreement, you authorize LAVS to charge your designated payment method for all rental fees, late fees, and associated costs under this agreement. You agree not to dispute or reverse these charges (a “chargeback”) while still in possession of LAVS’s property.

· Immediate Liability: If a chargeback occurs while you retain possession of the instrument, bow, or case, you will be immediately liable for the full replacement value of the rented item(s) in addition to any rental fees owed, late fees, and collection costs.

· Collection Enforcement: LAVS reserves the right to pursue legal remedies, collection actions, and reporting to credit agencies for any outstanding balance resulting from an unauthorized chargeback.

Collection

Upon request, you are obligated to promptly return the instrument to LAVS. Failure to comply with this requirement will result in the obligation to pay the complete suggested retail price of the instrument, in addition to any outstanding balances. You hereby agree to cover all associated collection expenses, which may encompass but are not confined to, collection fees and legal fees. By entering into this agreement, you grant LAVS the right to access your personal credit report at any point during the course of this agreement. You also consent to allowing us, our representatives, and those to whom we delegate, including debt collection agencies, to communicate with you for the purpose of this agreement.

Termination

The renter may terminate this agreement at any time without penalty by returning the instrument in good condition, along with the bow, case, and all originally provided accessories. Missing or damaged items will be charged at current replacement cost. Instruments must be returned directly to LAVS. Returns to schools or other parties are not accepted.
